Well done Santa for an excellent and cogent letter to your MP.
When you say the Government have chosen to "tolerate" that course of action, what you really mean to say is that they accept there is a loophole and that the scheme really does work.
We need to get Stephen Timms to respond to why HMRC pulled the four court cases last year rather than let them go to court and test the scheme. Their argument that it is time and cost is not an acceptable or sustainable argument.

Well obviously some of us havent been included in MP's latest letter. Again. WTF cant they make sure everyone gets stuff from them and not just a few people?
