      JCHR document

      A couple of things:

      1) I have received 52 testimonies so far. This is building into a very compelling piece of evidence. Keep them coming.

      2) I have decided to remove all names from the document. This is not to protect people's anonymity as such but I am concerned that if it contains names then it will restrict what the JCHR can do with the document ie. it may fall foul of the Data Protection Act.

        Great stuff DR. Have just sent my details on - sorry it was late - have been away.

        I aksed John Redwood to speak to David Cameron (and others) about our case - and I think that may have happened but I am yet to find out any details.

          Still awaiting outcome of PwC hearing. Watch this space...

          Now up to 58 testimonies. My original target was 50, but now I'm thinking 100 would be a nice round number.

            !!! Update - PwC hearing !!!

            The hearing has gone on a lot longer than expected. They have recessed for lunch; back at 2pm, when a judgement is expected.

            A few (unsubstantiated) snippets:

            1) There are 4 further JRs in the pipeline

            2) The only defence HMRC have put forward is on technicalities - PwC didn't apply for the JR within the 3 months; the client Mr Shiner hasn't received a closure notice

            3) There is a rumour that Mr Shiner was previously offered a deal - no interest or penalties.

            To be confirmed later.

                  The Judge indicated this morning that he is struggling to decide what to do about this with all the other applications pending.

                  HMRC have opened up a massive can of worms with this. The PwC team reckon HMRC are going to do everything they can to try and avoid it going to court. They want it go to a Commissioners tribunal where they can control the situation.

                    In him struggling is that good or bad for us? If he cant decide why doesnt he just let it go to court..?

                      Well, quite. It seems odd, this is just a hearing to decide whether there is a case to answer or not. If there is the slightest doubt that there might be one, then surely the only answer can be to grant a JR?
