I've not seen the actual JR documents, so maybe I have it wrong.

Just wanted to delurk. The information and time some people are going to on this forum is simply commendable; it is extremely appreciated.

I have been with the scheme since 2005, and I dont have the money to pay the bill. I have a family, so this at times ascends from feeling overwhelmed to feeling damned right angry at the injustice. The only good to be distilled from the vessel of anger is the passion to remain steadfast, to get up and fight the next battle; shoulder to shoulder. I have no ability to know how this will eventually end, but I know I will die with my sword in my hand.

Today, I stand well, rested and prepared for the next phase. As a husband, a father, a citizen of the United Kingdom, I will make sure I do everything to protect the wellfare and future of my homestead. This is not just some triviality, just some dispute over tax. The fettling and the massaging by the HMRC of the truths to change reality is nothing but a repugnant miasma of corruption and underhand abuse against the populous.

It is not the tax I must pay that drives me forward, but the heartfelt desire to ensure I have done the very best that I can do to help my children walk alone into a world that is safe, respectful and fair.

So far there is nothing of this case I would wish to share with my children lest it begin to engender a simple mistrust in humanity. Thats why I stand well, rested and prepared for the next phase.
beautifully put, welcome to the thread. no doubt there will be a morale sapping missive from the liars at HMRC winging its way. No-one should crack, no-one should pay up. I feel perhaps MP maybe didnt put as much effort into the application as they might have, as no justice is their right mind would deny if all the facts were known. A lesson will have been learnt Im sure.

Forget about speling and grammer. That's the least of our concerns here.

            Freedom of Information Request

For info, I have submitted the following request to HMRC under freedom of information:

If they reply saying they don't keep this information then I will point them right in the direction of the man that does.

This FOI request concerns the scheme closed retrospectively by Section 58, Finance Act 2008.

It is known that some taxpayers who used the scheme had their enquiries closed by HMRC and gained a tax advantage. Can HMRC provide a report on this, including:
            1) the number of users who benefited from this tax advantage
            2) the number of enquiries that were closed where there was no additional tax to pay
            3) a breakdown of the financial value to the users of this tax advantage
            4) the total cost to the Exchequer of providing this tax advantage

....and besides, HMRC will get a copy soon enough
There's an elephant wondering around here...

If you are facing financial ruin

You absolutely must send this letter. No if's, but's or maybe's.

I have a version tailored to those who will be bankrupted. When you read it you will understand why you should send it.

Send an email to me now at bn66_letter@hotmail.co.uk and I will send the Word doc by return.

Even if your MP is Labour, it is still worth it as you can see from an email someone sent me this morning:

My MP (<Name Removed>, Labour) lives opposite me and we've clashed via mail and on the street a few times. He was on the finance committee and voted for the bill. When I pointed this out to him he sounded genuinely surprised. I don't think he understood what he was voting for.

Forward your letter on to me and I'll happily mail it to him to see what the reaction is. Our last exchange ended with him stating that although he couldn't publically support a JR, he hoped we win it!

PS. Montpelier have seen the letter. They can't be seen to be supporting this activity but they haven't raised any objections either.

The retrospection begins from the budget of 2008

I did not join the scheme until 2004 and the first funds did not come through until 2005. I was not made aware of any HMRC enquires or objection to the scheme and was given to understand that the scheme had been operating since 1987 and was watertight but to expect HMRC to close down the scheme sooner or later.

In 2006 shortly after the budget I received a circular letter from Mont P to comfirm that there had been no changed to the legisation and that the scheme was still OK untill the next budget.
