    Closure Notices

I have yet to receive a closure notice. What do you have to do if you get one? I assume you fill out the appeal form and send a copy to MP? Is there any specific wording or references (EU Human Rights, Judicial Review) that you should use?

I am in Australia at present. I wonder if I was the person that Brillopad was referring to? Brillopad do you work for MP?

I cannot believe that HMRC is using standard surface mail to send out the closure notices. How unprofessional and cheap. They should be using registered mail to prove a notice was delivered and then give the recipient 30 days from then to appeal. What happens if the notice gets lost in the mail does the affected person lose their rights to appeal, surely this could be contested?

      Possibly a silly question but....

In your closure notices, how much is HMRC asking for, as a % of gross income during your time with MP?

You would have already paid MP a fee, and some PAYE I would imagine -- so these into account, plus the additional tax now demanded, is your total tax (& fee) burden something like 60%?

So you would only get to keep 40% of your income whilst working through MP?

dont fill anything in, just fax the whole thing to MP, they will complete and file the appeal for you

I'm just hazarding a guess that HMRC will charge 40% PAYE, plus N.I., plus interest. Is this correct?

i dont htink so - i think its 40% of the bit AFTER you paid mont p - plus NI at empoyees rate whcih is about 2-3 % isnt it so i reckon its about 46% plus interst

so that would mean 46% plus interst to the HMRC so around 54% for us peeps

<mod note>Why don't you contact the administrator and ask for you account to be upgraded, as suggested at the beginning of this thread?</mod note>

I still havent received anything, I wonder if they'll stop issuing closure notices once the appeals start to go in, or would that make far too much sense...

I had a reply from my MP - it says

                      Thanks for your letter….

Please be assured that conservatives have been proactive in addressing the concerns surrounding this particular aspect of the 2008 finance act.

During debates on the legislation the shadow exchequer secretary challenged the retrospective nature of clause 55 stating ‘ the amendments contained in the clause are to be traded as always having had effect . either the law exists or it doesn’t’

Jayne Kennedy, the financial secretary to the treasury responded for the Gov by saying that the changes were a clarification of the law and a re ‘fair, proportionate and in the public interest’

The debate was lengthy and wide ranging. Should you want to read a full text you can go to… and it gives a web link of the transcript

And thanks me again for writing.

SO what dioes everyoen think ......... does this mean we did what we could but wont be helping you any more or have I misread that and the 'please be assured' para means they are still going at it? wht does anyone think
