    Its important to remember how most people on the MP scheme arrived there. I got there through looking for an alternative approach as a result of the uncertainty arising from the poorly worded legislation called IR35. Nearly all of us were there once.

    There is no need to be divisive or unsupportive of those in fear of Hector attacking their IR35 status. What we all want is good quality tax legislation that gives us reasonable reward for the added risks and above all, some certainty over our affairs. Yeah, ok, it would be great too if Hector could be just a little bit reasonable.

    The Dragonfly decision may not be what the contractor community wants to hear, and sure we feel sorry about him having to pay the 100k, but it will add some more clarity to contractor's contractual situations.

        I'm sure the Revenue believes that wins such as Dragonfly will persuade more contractors to throw in the towel and operate inside IR35. The trouble is it will also drive many more into tax avoidance schemes, just like it did 7 years ago.

        It's a shame the government can't think outside the box and come up with a compromise where freelancers pay the same maximum % of tax&nic as employees. Ok they would lose the employers NI but I'm sure a majority would sign up for this and they'd probably collect more revenue as a result.

        There is no point the government coming up with a regime like IR35 which they believe is "fair", if the majority simply work around it.

              If I was in the MP scheme, I would have insisted MP (if they are talking!) set up a closed forum with only the scheme members. Although I follow this thread with great interest, I wouldn't want some of what is said to be freely available. I would not have thought MP would want comms from them to be freely discussed either.

                IR35 simply isn't fair. When you know you're in it you end up paying more tax than a permie with none of the benefits and all of the risk. When you believe you are outside it you live in uncertainty for years to come. Yet when you are caught by it and deemed to be an employee, the law does not support you in claiming employee rights. So Gordon, is this how "right and fair" should work? And as you said DR, this is why the tax avoidance industry is the only growth industry at the moment.

                  Alot of the recent communications have not been put up here - we know who is watching! (BTW hello )

                  MOST in montpelier believe that one letter every 3 months is fine! And that answering our questions as and when is okay too!

                    eg What is the status of the application for a JR?
                    What support has Montpelier got from other scheme providers affected by S55 FA 2008 eg the major accounting firms?
