Re HMRC Bullying, does anyone know if HmrC will have to delay issuing assessments until after all court cases are heard, or will they issue and we will have to appeal pending court judgement or whatever,

They will issue assessments as soon as they've got the accounts and the finance bill becomes law. Some people have suggested it could take a few months for them to send them out but I don't believe that. I reckon we'll get the brown envelopes before the end of August, and then we will as you say appeal pending the court case. The brown envelope is just a formality whenever it arrives.

They ain't getting a penny out of me until a court decides that their crock of sh*t legislation is fit for anything else other than wiping your a*se on!

A: taken HMRC so long to legislate, 6 years!!!!!!!
B: why they decided to legislate and not litigate speaks volumes, basically trying to sneak it in the backdoor so nobody would notice in a vain attempt to make it more difficult to refute. The "Will of parliament" concept makes it tougher once it becomes legislation, but if you read all the debate transcripts you will see not many people agree with it but rather than lock horns with the government decided the best approach was to let the courts rip it to shreds....

Basically another ******* waste of tax payers money on a legal battle they could well lose anyway, what a bunch of wasters....Wonder if they would be so bold if it was their hard earned!

MAybe if HMRC stopped trying to take on the world and P*ssing money away on litigation there would be more cash for important stuff like health, education, policing etc etc....I think there should be a publication of how much cash they spend each year on failed litigation, and they should be held to account for it!

Just had a thought on the way home, an angle nonone's mentioned yet. If it takes 2 years to get through the echr, the bogus, mandateless bunch of charlatans currently squatting in Parliament will have been booted out of office 6 months prior. What chance the incoming conservative government, who rightly challenged the retrospective aspects of BN66 in the treasury committee, will repeal this sh*t...

I've thought long and hard about this and I am convinced our best chance is to all stick together behind MontP. They may be cr*p at communicating but they haven't let us down so far. I think they deserve a chance to see it through to the end.

If it takes 2 years to get through the echr, the bogus, mandateless bunch of charlatans currently squatting in Parliament will have been booted out of office 6 months prior. What chance the incoming conservative government, who rightly challenged the retrospective aspects of BN66 in the treasury committee, will repeal this sh*t...

The problem is that the Conservatives will inherit such a mess from Brown & Co, that they'll need every penny they can get. They may disagree with the legislation but I can't see them doing anything about it. They are going to have a lot more pressing matters to deal with.

Very valid, HMRC really arent very good in court are they, as can be shown from 1500 IR35 challenges of which they won, how many was it, one?
Their arrogance always gets the better of them, 'how dare you challenge us, we're the government for gods sake', they're just crap at presenting evidence and reasoned argument, and in this case, what reasoned argument can they possibly make. If they can't do better then Jane Kennedy in the Treasury Committee, I think they will lose. Mr B, if it's you who'll stand up in court and defend the indefensible, then study the TC minutes to see how not to do it. Oh, and this time there'll be no 3 line whip or majority to push this bullsh*t through.

If you have a conservative MP why not write to them and ask them ? If you don't then write to the Tory lead on the committee. I happen to see my MP regularly for a number of reasons and constantly badgered him about IR35, this got to the stage of mentioning me and my comments in the various debates (and it didn't trigger a visit from hector ). He also made a speech reiterating the we will repeal it position.

Unfortunaltely it seems to have dropped off the agenda a bit since 2001 but I don't think the officail agenda has changed.

I am fairly sure a number of MPs are receiving correspondence. If this continues then they may well have to state a position.
