It could have been worse - he could have been selling the big issue.

        lowdown on TW scheme

Its not a negotiated deal with hmrc, it apparently uses hmrc's own guidelines to determine that 100% of the tax is due, but not from us, from the UK based company that MP uses to invoice clients and distribute the income. TW states that although HMRC may be reluctant to accept this, their own guidelines state that they must. research is by alan jones which made me nervous at first, but then i guess he knows the intricacies of the scheme as well as anyone. apparently HMRC may be more willing to accept his contention if the taxpayer is likely to become insolvent as a result of the liability. there is also probably a limit on the amount that could be recovered this way as the uK based company may quickly become insolvent itself if HMRC accepts TW's contention. hmrc are stonewalling with regard to any possible reduction in the liability, so once again, no negotiated deal, MP are probably the best hope for this in return for not pursuing any court action, depends if they are meeting this week to talk surrender terms or not.

            Keeping money from HMRC's grasp

I had a PM from someone asking if there is any way to reorganise your assets so they can't be got at by the Revenue if they come knocking.

My feeling is that they would quickly suss you out from your bank records and it's probably a waste of time.

The sort of things people may be tempted to try are:

            1) put everything in spouse's name
            2) pay a chunk off the mortgage
            3) shove it into a pension
            4) squirrel it abroad, swiss bank account etc.

Does anyone know of anything that might actually work? I guess it would help to know what their powers of recovery are. For instance, can they force you to sell or remortgage your house? Can they seize assets like cars?

Give your wife the house and then divorce. Re-marry after you've been declared bankrupt

                Tim Warr Scheme (beware)

If Alan Jones is the "brains" behind this then tread very carefully.

Ask yourself the following question. How did HMRC become aware of the MTM Scheme even before any tax returns had been filed? Answer: probably because someone (with a grudge) tipped them off.

I would not be surprised if Mr Jones still bears a grudge. After all, MTM went on to make millions out of the scheme, whereas he got hauled up in court and had to close his rival scheme. I don't think you will find many in his scheme have a good word to say about him. And, to add insult to injury, having let all these people down, he then goes and sets up ir35amnesty.com.

It does not surprise me that he wants the Revenue to go after MTM but I think you have to wonder what his motives really are.

I don't know about your wife but I'm not sure mine would want me back if I was bankrupt!

As an aside, I did ask MTM several years ago what would happen in the event of my death if the investigation was still unresolved. They reckoned that the Revenue would still go after my wife (as heir to my estate) for the money.

I reckon that is the case. Even if she knew nothing they assume she knows everything...
