    Agency Not Paying Invoice

    Hi Guys,

    I am in situation where my Agency is saying they are going to terminating my Contract immediately(same day/today) due to performance was not up to their expectations. Also Agency says they pay only 5 days however my working days are 22. I have timesheets approved for 12 days on January and Feb two weeks are pending as feb is not finished yet.


    I am not mentioning the Agency name here but i will update it soon.

    Could you please advice what i can do now

    Has the agency said why they will only pay 5 days? Did you opt-in or opt-out? Have you pointed out you have 12 days approved?

    Is there any chance of getting approval for Feb time?

      If your performance was anything like your grammar I'm not surprised.
      If you have signed timesheets for 22 days then that's what you are owed. If you have worked days but don't have a timesheet do you have any other evidence?
      Just invoice as normal, and if they don't pay google "Dunning process" and follow that.
      Forget the rest of Feb, you're not going get that, unless you are a FTC/PAYE type contractor (i.e. not a LTD company).

      Update your CV and get it out there.

        This about sums it up.

        Why do you only have signed sheets for 12 days? Is the other 10 two weeks in Feb you haven't worked yet? Forget anything you haven't work yet. You don't get paid for not working.

        If they offer 5 push them, if they pay the 12 days you've got signed sheet for then you've hit the jackpot. There isn't a hope in hell of getting the rest back without a legal fight which will cost more than the missing money.

              Payments are processed first week of every month, So i do get approvals on or around 1st of every month. I worked 10 days in Feb till today.

                get some evidence.
                Even the agency writing an email saying they "don't care if you worked you're not getting paid" is still evidence you did work.

                  You need something in writing from the client to say you worked those 10 days. Even a quick mail to your client manager saying 'Can you confirm I was available and worked for x days between Y and Z.'

                  That said I assume it's your client getting rid of you so they may not be too forthcoming in which you are in a bit of sticky spot.

                    Whatever the client do or say, the agency will try and chase the money. If OP has not got timesheet the agency would be within their rights to keep the money, unless the OP can prove they did the work.
                    So yes trying to get the client to confirm, or any other form of evidence is essential for the OP.
