Does client need to issue SDS if contract does not extend beyond April 6th 2020?

Simple query - is client obliged to issue an SDS for contractors that are not working into the new tax year?

Have some mates who will go perm in mid-March and they're unhappy client has issued an SDS even though they will convert to perm.

SDS states inside IR35, hence they feel there was no need to issue any SDS as they're converting to perm.

The client doesn't until April 6th, but as the client already has, the damage is done...

So they don't like the fact the clients shafted their previous outside determinations.

Client didn't need to, they've made a mistake. Unfortunate.

Nothing can be done about it now..

if they'd closed down their company then their client wouldn't have been able to issue an SDS.

Erm... you think? And they could have done that in time?

What makes you think they wouldn't? Client would've needed approval for permanent headcount which would've taken time to get. They may have also checked there was interest in a perm offer with the contractors before engaging for approval internally.
