This means you are not an employer for Pensions Regulator but employer for PAYE.

Hope I didn't confuse you too much!
It is one director + one employee. So it seems I am an employer.

        How do you opt out?

To opt out, you need to ask the pension provider for an opt-out form. Your employer must give you the contact details for the pension provider if you ask for them. You should complete and sign the form and return it to your employer (or the address given on the form).
How do I know who is the pension provider?

That's the question. Is it NEST?

OK, have you, your director, your employee or your accountant enrolled anyone in a pension scheme?

If the answer is yes, then you need to find out what pension scheme they are enrolled in.
If the answer is no, then there is nothing they can opt out of.

First port of call - ask your accountant/financial advisor.
…Maybe we ain’t that young anymore

OK, best get yourself a good accountant who knows how to work with contractors (i.e. not the cheapest accountant you find or a friend of a friend), then ask them

It's for providing help and advice.

We provided help and advice, you weren't interested in heeding it. Not our fault.
