    DOB for HMRC

    Client HR have requested my DOB for HMRC documentation. I knew there were new requirements for agencies but I am direct with the client.

    Is it now a requirement for direct contractors or is Client co HR misinformed?

    Alarm bells - get your contract checked for IR35 or at the very least advise that you are operating a supplier/client relationship.

      Contract was reviewed and insurance in place. I just wondered if the reporting remit was expanded or if this is HR being dense.

        Ask them what documentation. I wouldn't put it past them mixingup some right to work legislation with HMRC. IMO the devil is in the detail here soon wouldn't act like a dick at the first opportunity. Ask them exactly what for and take it from there.

            Your call then. I can't think giving your DoB in response to some misguided HR question will make a difference to your IR35 status. I'd be interested, both in here and in your shoes why though.

                In all seriousness, when I go direct, I prefer being engaged as per any other consultancy supplier rather than as a person - the onus should be on my ltd co to ensure that its workers are eligible to work in the UK.

                  Should be but with current level of fines and nightmare legislation around it you can forgive a client for doing their own diligence. I certainly would if it was the other way around.

                  Also all the guidance is aimed at employers who employs staff under a contract of employment, service or apprenticeship. Am sure a client will believe you are the middle one so they are obliged to check.

                    I'd agree if it were a sole trader that I'm taking on but why should any limited company be different to any other? Would they ask Accenture or EY for personal details of all consultants coming on site? I doubt it.
