    Well, it is interesting that the legality has been brought into question
    To be honest its not. Every 5th post has been questioning something and calling it illegal because we don't like it. Even if someone did find something that might be arguable no one is going to take it further anyway.

    Well, it is interesting that the legality has been brought into question but the route to claim back taxes based on an incorrect Inside determination looks even worse now than it might have before.

    The thing is, since in times past whereby the HMRC had to review both the contract AND the past working practices to ensure words married up to practices when determining an Inside or Outside decision, with the client having to predetermine without any practices to later review, the retrospective claw back route is needed.

    One hopes.
