No contract signed for loan agreement
Dear respective members,
I am in the same boat as you guys, I worked for 12 months in total over 2 financial tax years, but I did not sign any loan agreement with Eximius Consultanting, but I have received a letter from HMRC stating I need to pay back tax on the loans I received, I wrote back to them telling them I am willing to pay back the money I owe, my question is will this include
1 National Insurance payments.
2. can I extend the payments over 5 years without interes
3. If I did not sign a loan contract with Eximius, can I use this against the HMRC as a get out clause but I would like to thread carefully because, I do not want to aggravate my options with HMRC, I believe, if you are cooperative with them, they will be willing to accommodate.

I found it helpful to call their helpline a few months ago... but it seems to be super difficult to get through now.
You should get the information to HMRC prior to 30/09, to get the chance to settle.
If you only used the scheme for 1 month and no longer work in the UK, you may be in a much better position to bear the loan charge in 2019. To do that, you will have to fill out another self assessment for 2018/2019, and declare the loan income as a part of your income for the year. If you no longer are a UK tax payer, you may get a tiny tax bill for the year. However HMRC may go back into the tax year when you got paid through the scheme and reassess your tax for that year. In that case, any tax you paid on the loan in 2018/19 will be offset against what you owed for 2016. You may, however, be charged interest on the net amount which they may assess as due for 2016.

Hi All,
It's such a relief to scroll through and read some of these messages. I thought I was the only one.
I thought Eximius were deep down in my past, I haven't worked under them since 2016 and even then I was only a client for just over a month. My recruitment company rejected them in audit. Time to Fight
Dear all,
I along with 2 others (that we are aware of) used Eximius when we were working abroad, but in the EU.
THL are a new company run by and older lady and young lady of 19, it was all part of a plan for sure. It's pretty obvious what's happened to all of us and frankly disgusting.

I have someone acting on our behalf and we wrote to Eximius and to date have to my knowledge not received a reply. We have received a standard letter from HMRC which uses ambiguous language, which I believe is designed to frighten people and extract monies quietly to avoid bringing about a scandal.
How innocent members of the Public are being used to be the fall guys / gals is beyond me. Someone here is making money through deceit, I have an idea how. Whilst morally wrong, morals do not put you in Prison.
Our team are going to fight it and one of our lot said, we are stronger together, he is spot on. Currently we are waiting for our consultant to advise on our next move and I will inform the forum.

Hi,
Very reassuring to know others are in the same boat.
Really could use some advice at this stage as to where to turn to next.
Like others I have no idea who to trust regarding the years that I was with Eximius.
For me Eximius have shutdown, re-started under Previse (They are getting a call tomorrow).
In the meantime some group of Trustees have taken it upon themselves to start chasing former Eximius customers and also contact HMRC with former customer names! Very helpful and totally against what they promised.
This is a real mess.

So assuming your ‘salary’ payments have been duly declared in your SATRs (check to make sure), you only have to declare the sum total of the larger payments received from Exim.
In the declaration, for the sake of transparency, also state that smaller payments received were declared in the year’s SATR.

If you take a look at your bank statements plus any monthly paperwork Eximus may have sent out, you should be able to see how much was loaned to you.
You could also talk to Webberg who works for WTT or Phil @DSWTRES as they will be able to give you more advice.

Struggling to get sorted... Don't trust THL. Please help!

2. Professional Independent Trustees Ltd.

Do you have a number that I can reach you on?
I’m not going through THL as I don’t trust what eximius or their associated partners are offering.
We’ve gone directly to HMRC, see what their pack entails and then decide what will the best option after that.
I suspect eximius will try their dirty tricks to claim some money for release of loan, which I’ve discussed with some experts, who have advised it will laughable, they have no chance.

I was on the verge of registering with THL just to check out the terms 'loan settlement offer'. Not having KYC documentation at hand delayed that process for me and I then discovered the 5% + £250 fee, which obviated the need to provide THL with any more of my information.

Please be very wary of listening to scheme providers and their associates.
Get with like minded people such as LCAG https://www.hmrcloancharge.info/
Do not feel you are alone, and please do not despair. This is a roller coaster of emotions, bad days, and not so bad days...
As for Big Group, I have been a member since the very start, and feel assured people are not lying down and taking this without a fight back.
We all need to get active and hit back, contact your MP etc, there is help on how to mobilise.
