No, thats why it got overturned. The original agreement with the US to export the data was signed by the commison was based on the principle that security data was not coverd by the Data Protection Directive. The court has over turned this descision.

Dont get too excited;
The European Commission took the decision under the EU Data Protection Directive, but the directive does not apply to data collected for security purposes.
