We could, but since US also banned online Poker using real money, I don't think it's a worthwhile argument to have.

We could argue whether forex is gambling or not.

More likely issues are:

1) that competition law there is a b*****d and its better to run separate competitions for the usa and the rest of the world
2) investment rules are different and for eu companies it ain't worth the pain.
