This court case wasn't a criminal prosecution. Depp chose to sue for libel. I agree, sadly the main stream media seem intent on pursuing/destroying only one party. It should be noted that the case only discussed The Suns right to call him 'wife beater' and nothing else.

If she physically abused him then she should be prosecuted but it is still no excuse for him to abuse her. Two wrongs don't make a right.
