Now define consent sensibly in such matters and we are home free, this seems to be the problem.

Theres that weird idea that you should always get explicit consent from the start. If that were to be the case the human race would go extinct! because no one ever got laid by asking for permission

I don't like those posters that say something like

That implies that Jess must be sober to be responsible for her actions. If the same applies to dave then he can't be responsible for rape if he was drunk.


I think it's simple common sense (and of course there will always be grey areas which is why we have juries etc) basically what MS said.

If she / he if incapable of protesting, then they can't consent either explicitly or implicitly. Apart from that a regretful experience is misadventure - not rape (with some differences potentially where there is a significant imbalance of power/authority - and in most of those cases it would be a professional or social matter - not a criminal one).
