That's not to say you should go grab a random stranger and go in for the kiss or touch them somewhere!
I don't like those posters that say something like
"Dave was drunk last night. So was Jess. Jess couldn't consent. The next morning Dave was arrested for rape."
I think it's simple common sense (and of course there will always be grey areas which is why we have juries etc) basically what MS said.
If she / he if incapable of protesting, then they can't consent either explicitly or implicitly. Apart from that a regretful experience is misadventure - not rape (with some differences potentially where there is a significant imbalance of power/authority - and in most of those cases it would be a professional or social matter - not a criminal one).
There we go. Problem solved. Elect me Attorney General.
