The extension of my current contract ends on the 21st December and the second extension is to start on 7th January.

MOO, RoS and xmas

Hi All,

Don't plan on working over the holidays and the client is not expecting me to.
From an IR35 perspective is it better to offer to find a substitute therefore enforcing the RoS clause in the contract even though they won't take it up.

Or is it better for them to say I'm not required showing a lack of obligation to provide work?

Or would both be viewed as a sham in an investigation?
