Scooby - am absolutely positive (based on personal experience with Futuro) that the agency will not be able to cancel any invoices already raised unless the administrators agree - and they won't. They can freeze payments if they want but they are still liable for the debt - company in administration is not a valid legal reason to fail to pay.

I wouldn't hold out much hope, as any outstanding invoices will be paid to the administrator, they can't just unilaterally "cancel" them. Of course it is possible that the administrator might negotiate with new company.
Usually the administrator runs the company until it is finally wound up. So it will still exist as a legal entity, and anything you do has to be agreed with the administrator, as his job is to get as much out of any outstanding work in progress. Once the bankruptcy has been announced effectively your contract is void, so anything you do after that is can be renegotiated.Last edited by BlasterBates; 2 August 2007, 12:26.

It's important, I think, to avoid pondering the infinite permutations and possibilities, else you end up with a Rumsfeld Box on your hands.
Think smart and stay ahead, say I.

Depends on the contract - usually they state "ceases trading", administration is not ceasing to trade.

If someone goes in to administration then i believe contracts can be made void meaning if anyone is with them leaving fees wouldn't apply and people can get out if they wish straight away

Administration is by it's nature temporary. So can't argue with "temporary administration". Only question is what comes next and whether they emerge from it.

I was told recently that my "umbrella" was going into administration. Being spread by an agency. Turned out they were just moving things from one company to another. Its all fine.
WA might be right - but I dont trust agents and the dodgy rumours they spread. And before DA pulls me up, I dont trust contractors either.

I just don’t trust any umbrella company that goes in to administration!
Can't complain though they have been helpful for the short time I have been there and assure me that all moneys owed to me will be paid.
Bye bye P4!
And a wise man you are.
