    Forgot to add that QDOS had project milestones down as neutral. Had a few other things altered and contract was a PASS. Nice to be off the bench finally.

    Which then begs the question what else is in there just for the benefit of the contractor and doesn't match working practices. The MoO, RoS, D&C clauses? Not good to have such a blatant sham in the contract. I'd argue that's detrimental to you IR35 status, not a benefit.

    Maybe your reading this incorrectly. "Against project milestones" is a bit vague amd could be interpreted differently.

    E.g. you have to put on the invoice what project milestone the time was spent doing.

    What does the rest of the contract say about invoicing? Must be more than this, Shirley?

    Whic it might but if it mentions milestones that then don't exist so is a bit of a crock it's going to be hard to prove these aren't either so doubly important to fix this so the clauses you need will be believable.

    I've had that from agents. However having had an interview I have written in myself services to be delivered.

    Some agents have accepted it straight away, others only have accepted it after speaking to the client and some have refused it so I've demanded it to be removed as there has been another clause mentioning services to be agreed between my company and the client.

    How weird you must be missing a sheet with said Milestones on it.

    I can't imagine any Agency warming to this idea because if you can't invoice then surely neither can they, unless they are agreeing something differently for themselves with the client
    Maybe there is just one Milestone - Project completion!

    However there's a statement of work tacked on the back with a box for 'services to be delivered'. It is blank.

    Client wanted me on basis of cv without interview so it's got my spidey senses tingling. Be interesting when the review comes back.

    Thing is if you argue with agents you find even some more experience ones don't understand that you cannot agree to something in a contract that isn't defined.

    So if you hit a brick wall and you have the client's details be prepared to phone them, and check with them that they put this in the contract.

    Thanks SE. Only bit in the contract is "for all hours undertaken to reach previously agreed milestones" - I've agreed nowt thus far!

    It does seem a bit odd as the point below mentions that Timesheets must be signed by end client and then returned to the agency.

    They have even sent me a timesheet template, so it does seem to contradict each other.

    Are the project milestones in the contract?

    If not reject this and just agree to weekly or monthly invoices. Simply as you cannot agree to something that hasn't been agreed up front as what they are.

    Invoice against project milestones...

    Possible new gig but just trying to get a review on the contract (it's gone to QDOS for their quick turnaround service as been asked to start next week).

    Under payments it states: "Invoices to be submitted against project milestones..."

    Not come across this before, seems a bit odd as I'd don't even know what the milestones are and indeed if they are doable.

    Any advises?
