Read up on IR35 and understand it. Read up on Opt in/Opt out and understand it. Then you will know.
This has been discussed on here somewhere before as well I believe. Might be a bit of a trawl but it is here.

Opting in and opting out and bearing on IR35
People,
I understand that this may not be a simple question to answer but please advise if so called 'Opting In' or 'Opting Out' of the Conduct of Employment Agencies and Employment Business Regulations 2003 has any bearing on IR35 status.
After taking advice on this forum I recently 'Opted In' to the regulations and I then recieved a second contract from the agency with the option to 'Opt Out' if I wanted to do so. They advised that that 'Opting Out' route would be better for me in terms of IR35 legislation.
Thoughts on this would be appreciated.
