Through an agency? Do you have (or did you need) a signed timesheet? In what way do they allege you have breached the contract?

started a topic Claims Burden of Proof

    Claims Burden of Proof

I recently submitted my final invoice to the company I was working for and they have refused to pay the full amount due to them saying I was in breach of terms of the contract.

I have now thinking of giving the case over to some debt collectors, however was thinking of taking them to Small Claims Court myself, however where does the burden of proof lie, for the work I did. Do they have to prove I didnt do the work as they are claiming or do I have to prove I did do the work?
