Speaking with tax specialists and insurance companies, it's almost a given that HMRC will appeal to a higher court if they lose.
If that's the case, and reading about the contributions made to CK and the DK group (for Boox), what's the point in winning the FTT if CK or Boox have no funds...

Also, and forgive me if I'm asking so many questions (hopefuly it helps someone else):
- Before receiving the determinations, can you ask HMRC already for a breakdown (as per their informative letter), or do you see any problem in this? Could it trigger anything else?Last edited by ritwolf; 25 January 2023, 17:56.

Thank you for your comments, it's been quite a few sleepless nights since I received the letter.
Speaking with a friend, he tells me he doesn't think HMRC would go against so many people in bulk unless it's an almost-won case for them, meaning that they have investigated every possible...

HMRC states, according to Section 61B(2) ITEPA 2003:
a. Benefits financially on an ongoing basis from the provision of the services of the individual

I've spoken with a few specialists and, as you mentioned, they also think that HMRC could reject the appeal because it's so close to the 50% threshold. I don't understand, how can they actually reject the legislation because it's "close" to the number, and then be so strict when it suits them...

jamesbrown - is this still valid? if so, do you know what period would you have to apply it for (e.g. 2018-2019 tax year or natural year...). I checked for the period 2018-2019 and the payments are just below half (around 48-49% of the amounts invoiced ex VAT.
