HMRC confirmation of appeal

I got my confirmation letter today from HMRC that the appeal has been successfully received. This was about 7-10 days after they actually received it via Cobham Murphy. The letter is very short and just says the appeal has been accepted.

On my HMRC self assessment portal, the outstanding amount for the 08/09 year is now marked with "Revenue assessment - Currently suspended on appeal".

The above case is relevant to all EBTs generally, insofar as it's another example where correctly administered EBTs were legal (prior to Dec 2010) but there will also be some EBT schemes that are slightly different and HMRC may choose to look into them on a scheme by scheme basis. Note that the Rangers case is still ongoing, and HMRC may yet overturn the decision.

Suggest you read up on the threads in this forum a bit further. There is plenty of info. Your next step is either to appeal, or pay up. If you want to appeal you can either go via Cobham Murphy (as some Sanzar folks have done), or you can engage a different tax specialist, or you can write your own appeal letter based on templates already published on this forum.

Indeed, educating yourself is best way to alleviate some of the stress.

At the end of the day HMRC have known about these schemes for years and did nothing much, but political pressure is being brought to bare, the very same politcians who claimed ridiculous amounts through expenses. So now HMRC feel they have to act, however existing case law can not be thrown away and discarded. I feel more comfortable that our legal profession are not as corruptable when it comes to morals, and will look at the actual points of law.

They do indeed seem to be staggering these .. I came home to an HMRC assesment (in the tens of thousands) on my 08/09 SANZAR engagement, on Friday evening, to ensure I had a sleepless weekend.

I already had a letter back in December, querying the loans/repayments, during my 10/11 return (which they also managed to deliver on a Friday).
For the 2010/11 enquiry I engaged Cobham Murphy, (as advised by Contractor helpdesk) and they told me not to expect any movement before Easter.
I have e-mailed Contractor helpdesk regarding the 08/09 assesment but have not had a reply, as yet.

Can I get PM rights? as I have a couple of questions I wouln't mind asking more privately

I'm in the same boat....

Was with Sanzar 08/09. HMRC claiming I owe 20k+ for this period. Have emailed [email protected] today, hopefully they send out the appeal letter ASAP. Please keep me informed of developements and i'll so same. Cheers

Seminar on HMRC actions, EBT's and Tax Assessments/Enquiries/COP 8

Surprisingly, I have received a luke warm response to my offer of a free seminar to answer all your questions about these HMRC actions and likely future developments, which will no doubt create a further panic each time they do something.

HMRC are committed to pursuing ex-employees of EBT, non-EBT and profit share DT Treaty schemes in use prior to 9 December 2010.

It therefore makes sense to obtain solid, informed and jargon-free professional advice from a recognised tax specialist so that you can make informed decisions about how you should deal with this problem (which is not going away).

I ask that one person organises a group of at least ten to cover the expenses of the seminar and please see the EBT forum for further details.

There is no pressure to appoint a tax adviser and, indeed, I have spoken with many contractors that cannot afford to do so. Advice to those, in particular, will be invaluable. Also, those that wish to deal with matters themselves, through their own tax agent or who just want to wait and see what happens.

Some things in life are free.
