HMRC Enquiry letters on Loans from EBT and other schemes

    Another interesting kicker is that I now live in the USA, with little intention to return to the UK, although own some investment property there. As I will be Non-Dom in the next few months, I will not be subject to inheritance or capital gains taxes, so wondering if this affects the position I should take in any way?

        Not sure how any of this becomes a criminal matter, as mentioned above. If I don't / can't enter the UK again then it's no skin off my nose. In fact, this whole exercise has convinced me that plans for future overseas assignments will be considered anywhere but the UK and they will never see another penny, either as part of this debacle or from any future earnings. What a mess.

        Just wondering whether you've had any further thought to this? I moved to Aussie back in 2009 but still have a 5k debt with the HMRC.

        Haven't got anything apart from a small bank account in the UK now so not sure whether to try to pay it off or wait.

          Take some advice locally.

          HMRC and the ATO have a reciprocal agreement on many matters. It may be that the ATO can be asked to collect tax due and remit it to the UK.

          This is however a legal minefield and needs checking, especially as the ATO has a reputation of being a bad choice of organisation to cross.

                I know that they co-operate in exchange of information on tax but if it stops short of debt collection, so much the better.

                  Discovery POwers

                  My APNs for 08/09 and 09/10 have landed. Can these be challenged on the basis that the original inquiry was opened using Discovery powers when the scheme was fully disclosed from the outset and therefore nothing to discover. Also the loss of protection afforded by s29.

                    APN cannot be challenged on any basis. They are ultimate weapon with nothing to protect you.

                      APNs and warning letters starting to come in in dribs and drabs. The dog very kindly ate (what I suspect) is the first one, although it may have been the pre warning for the second one. Who knows...
