Views of deed of release - confused - very confused
Hi, I have agreed to settle.
I did not know I could be liable for any further tax (??!!). I have asked HMRC and if the loans are not written off, they have said, then I may be assessed for IHT. I have also explicitly asked if that as far as HMRC are concerned would be the end of it - and they have told me (albeit over the telephone) that that would be the end of it.
I have seen in other posts mention that the trusts are required to act in our best interests - how can I then be charged interest or be required to pay back the "loans"?
Payment of tax classifies the "loans" as earnings - no?

Decided to ring HMRC CA again**:
- whether the loans are, or are not, written off assessment for IHT will apply but this will then be the end of the matter for HMRC.
I have asked for clarification on these matters in writing but as the agent I spoke to was not confident and advised he would need to seek full confirmation from a manager. All managers who can advise being out on a "jolly" (a training course) so I will need to wait possibly until wednesday before I receive it - can you believe HMRC? They have a helpline....
