They may indeed have received the money, but they have made little attempt to prove it's rightfully theirs. HMRC admit they will have to give some of it back. The figure that they have chosen to use of 20% (i.e. 80% of cases are won by HMRC) is laughable; these are mostly complex cases where I suspect their win rate will be much lower.
