              The position outlined very clearly in Rangers is the fact that the loans are just that and UK legislation prescribes a statutory basis of charge for those and there is no avoidance. If there is no avoidance for those loans then equally that should apply to any employer related loans from an offshore employer otherwise anti-avoidance legislation is being used in a highly discriminatory way.

                Question:

                The settlement offer states that I must make contact before the 9th January. It says that if I don't, then my case will proceed to Tribunal. No mention of APNs.

                So say, for the sake of argument, I make contact, before the 9th, and agree a final amount several weeks later. What is the trigger to pay?

                If I don't make contact do I get an APN or a tribunal?

                It's not clear. I'm gearing myself for an APN - but will one arrive?

                  I am sure an APN and then HMRC will continue for force to settle instead of going to tribunal. Settlement is what HMRC wants without giving any discount but take away yr right to go to courts.

                    ...really odd - HMRC told my accountant that there would be no APN, just a tribunal.

                      Isn't this what HMRC are best at - Confusion. Do they actually know what process they are going to follow?
                      Will the issue of APN's be seen as illegal, unconstitutional or over the top.

                      Anyway - another comment regarding APNs against HMRC - from 2 hours ago.
