They ARE all punitive charges; and she doesn't have to pay them to claim them back because they are not invoiced, they're levied on your account. Basically they WOULD be able to insist that the refund went to clear her account, if they chose to. However, for the most part, they're paying up out of court, rather than defend... they know that they don't stand a chance. I have had over £1000 in refunds from various companies. -
She calls them "charges" though... are they costs? Sticky subject I know but she doesn't go into detail on the blog.Originally posted by StoneLaughterThey ARE all punitive charges; and she doesn't have to pay them to claim them back because they are not invoiced, they're levied on your account. The BANK calls them "charges". The BANK say that they're a genuine pre-estimate of cost. UNTIL you ask them to demonstrate this in court. Then they roll over, play dead, and pay up.Originally posted by cameramanShe calls them "charges" though... are they costs? Sticky subject I know but she doesn't go into detail on the blog.

Mine? I got only £1000 back over six years of banking and credit use. One guy (known as Seminole) got back £10,235, and he's trying to claim more - from ONE BANK. He's trying to use the Statute of Limitations against them... you really should have a look at the forums at Consumer Action Group if you're interested in all this (currently over 50,000 members, up to 600 active most of the time); saves us hijacking someone else's thread.Last edited by StoneLaughter; 4 August 2006, 08:58.Comment

Thanks for that but I've never had a bank charge/penalty, never been overdrawn, never not paid my mortgage or whatever...Originally posted by StoneLaughterThe BANK calls them "charges". speechless!!!
I just joined this board because I wanted to vent my spleen at this travesty being played out on the BBC web site, but I see that all you guys out there have more or less said it all for me.
The woman has a huge capacity for self delusion. She doesn't equate 'people who profligately spend money in the shops' with 'people who profligately spend money in the property market'. She feels hurt when commercial organisations take decisions which are in their own interests rather than in hers.
I can't believe how she and hubby went from what must have been a pretty secure financial position, to what is evidently now a desperate one, purely out of greed.
Wake up and smell the coffee, girl!Comment

I've just defaulted for the very first time on my mortgage. Turns out that a Direct debit is taken from your account at 00.01am on the day it is due, so transferring funds at 08.30am will still mean that if at 00.01am insufficient funds were available then the DD will be reversed.Originally posted by cameramanThanks for that but I've never had a bank charge/penalty, never been overdrawn, never not paid my mortgage or whatever...
This is despite having more than enough funds in other grouped accounts.

Nasty!
I keep at least 3 months mortgage in the account the DD goes from - easier said than done I know - in case anything happens. What happens - are they charging you?
I would be interested to know what charges the bint what's in debt is talking about, and whether she means costs, because with the amount of advice she's getting from various agencies and emails to the BBC site, I can't believe that someone hasn't told her she need not pay punitive charges.
Or perhaps people just don't like her!

Funny you should mention that. It's quite possible that she's got a history of being into a bit of Am-Dram.Originally posted by DundeegeorgeI hope they nail her to the wall, she's exactly the kind of asshole that gives real contractors (oh, come on there must be some of us on here!) a bad name. In fact she's almost a pantomime contractor, you could almost believe she's a stooge for the IR, couldn't you?
