    Got a bloody CCJ...

    ... for not paying the water bill. Just checked my credit rating.

    Ironically I have a tenancy contract saying that the landlord was responsible for it but the bugger has done a disappearing act (he was a complete gimp anyway). Can't call the local county court as the phone never answers

    Any ideas on how to get one of these cleared other than use a tracing agency to trace him and sue his ass?

    Phone the water supplier and explain that you're not liable and once they agree (send a copy of your TA if required) they'll update your credit score.

      I take it the water co never contacted you about the o/s bill and never sent the court paperwork to you to defend yourself against? In that case, you might be able to write to the court and state that the water co did not follow proper procedures as you were never informed of the impending action against you? Dunno if it'll work!

        You shouldn't need to trace him, send copies of the evidence to the court that you were not responsible.

          You can download a form from the Court service web site, it will be a “general application” or similar. The application fee is about £100. You need to fill in the form and ask the Court to “Set Aside” the judgement on the grounds you were not notified of the case and you did not receive a summons. This should automatically set-aside the Judgment. Write (do not phone) to the water company and explain. However the occupiers being you are liable to pay. You can then pay them out of court if necessary and claim from the landlord.
