As i said before you pays your money you takes your chance. I don't wish the tax man chasing anyone that used this scheme but neither will I offer any sympathy if they lose the case. Everyone is a grown up and they all have to decide for themselves how much "risk" they are willing to take in day to day life to get the rewards.Comment

I've been trying to follow this and it seem's some people are arguing for the sake of arguing based on the post they are referencing.
The way I see it this comes down to two points:
Exploitation of legal loopholes and retrospective clawing back of cash.
Anyone who objects to the exploitation of legal loopholes are talking out of their arse's, and if they do object to it while paying themselves a minimal salary and taking the rest in dividends are a hypocrite as as I can see that is just another legal loophole, which the HMRC have tried to close with IR35.
As for the retrospective clawing back of cash, I think this is a valid point for appeal as it saying you didn't didn't do anything wrong at the time but we are gonna change the law so that you did.Originally posted by Stevie Wonder BoyI can't see any way to do it can you please advise?

BN66 was about clarifying a loophole which had already been closed back around 1987. This was being deliberately exploited even though the whole intention of the '87 legislation was to stop the abuse of the DTA.
It's not a legal loophole and as the Courts said, HMRC have more important things to do than hunting down offshore accounts. This isn't gloating either, nobody forced them down that route, they took the chance and it hasn't worked out.
