    Well - if the agent found someone else they would just call to say the client had changed their mind I am sure and there is sod all you can do about it! If there was anything in the contract about guaranteeing the gig would start is that not a IR35 compliant issue?

    I'd be interested to see what the contract says about the notice period prior to starting!

          if your contract is outside ir35 hire someone else to do the first contract
          at a lower rate and take the second contract yourself, simples!

            If it is a month off then just serve notice
            Rule Number 1 - Assuming that you have a valid contract in place always try to get your poo onto your timesheet, provided that the timesheet is valid for your current contract and covers the period of time that you are billing for.

            I preferred version 1!

                And that's exactly the type of tulip that I want to prevent, if the contract is signed then your bound to do it unless you enforce your right of substitution or you give your notice.. and likewise on the agents side you would expect them to honour the contract and not do what they all too often do and serve you notice, tell you there is no work, no work = no signed timesheet = no pay and then hire someone else at a lower rate, EVEN THOUGH THE CONTRACT HAS BEEN SIGNED.

                I'm not saying it doesn't happen, I'm saying it shouldn't happen and that's why agents have the "they'd sell their grandmother" reputation and as a contractor you should not lower yourself to their level but try and do your work in an honourable fashion AS IT STATES IN THE CONTRACT..

                    the daily rate is what's stated on it, if you're gonna ignore the termination clause part then who say's it's not fair for the agent to ignore the daily rate part and pay you what he thinks your worth?

                      That's a perfectly acceptable solution and enforces your contract to the letter, best advice yet

                      The agency won't like it and try to get out of the Right of Substitution clause but that's what it's their for, your a contractor not a cowboy, think like one.
