          So is it deemed "statutory rape" when an artificial dildo is inserted? What is sex between two women defined as Unless the legal people involved in the case also used the word rape, I think we can dismiss that emotive term here too.

              Not really, sure it sounds like nonsense when the victim is boarder line age wise, but what if they are lot younger? Like a pedo might not actually physically harm, say a 8 year old, but doubt anyone could say an 8 year old is mentally equipped to make informed, mature consent in something like this. And rape is basically committing sex acts on someone without their consent

              Generally don't agree with cops/prosecutors chasing borderline cases in most situations, but then again "borderline" it's self is defined in many cases by those involved (aka maturity of the 'victim', age of the 'attacker', dynamics of the non sexual aspect of their relationship so forth) and the viewpoints of outsiders (cop/prosecutor/joe public).

              Just thinking of trying to write a law that would punish the guilty, protect the innocent but allowing for all those variables just makes my head spin, so don't really blame the law in how it classifies it all as "rape", just wish prosecutors would use some common sense in applying the laws (if you want really good "bad examples" of how good laws like this are misapplied by bad cops/prosecutors just look at the US)

                I don't agree. Nor do a couple of lesbian teachers who are friends with my wife.

                That said, I'm not sure the legal definition has been extended yet, but I think it should be.

                  I'm not sure this is borderline, I'll have to check but AFAIK teachers are restricted by law against having sexual relations with any pupil under their charge who is 18 or younger

                    I've looked it up - SA you are correct to the letter of the law, sorry.

                    Rape

                    (1) A person (A) commits an offence if—

                    (a) he intentionally penetrates the vagina, anus or mouth of another person (B) with his penis,

                    (b) B does not consent to the penetration, and

                    (c) A does not reasonably believe that B consents.

                    (2) Whether a belief is reasonable is to be determined having regard to all the circumstances, including any steps A has taken to ascertain whether B consents.

                    (3) Sections 75 and 76 apply to an offence under this section.

                    (4) A person guilty of an offence under this section is liable, on conviction on indictment, to imprisonment for life.
                    Assault
                    2 Assault by penetration

                    (1) A person (A) commits an offence if—

                    (a) he intentionally penetrates the vagina or anus of another person (B) with a part of his body or anything else,

                    (b) the penetration is sexual,

                    (c) B does not consent to the penetration, and

                    (d) A does not reasonably believe that B consents.

                    (2) Whether a belief is reasonable is to be determined having regard to all the circumstances, including any steps A has taken to ascertain whether B consents.

                    (3) Sections 75 and 76 apply to an offence under this section.

                    So it's not rape, it's assault by penetration (seeing as a 15 yo is unable to give consent). She's lucky she got 15 months and not life, unfortunately the statutory element prevents conviction in this case and she can only be charged with whatever they got her on (sexual activity with a child?).

                      The age of the girl (15) in this particular case makes this borderline for many people, but the "dynamics of the non sexual aspect of their relationship" (aka teacher/pupil) make it not borderline for many of those same people.
