    But the point I made about 2 is that the assault can be proven to be not fatal.

    I am trying to make non specific examples of specific examples of cases I know about. One where someone was killed by an act of violence which was provoked where death was accidental and one where there was repeated torture which was designed not to kill.

    My examples are simplistic but relative.

      4 years for an unprovoked murder (not manslaughter!) is disgusting. The pair should both have been locked up for life.

        Growing up I probably punched 10s of folk, I might have punched almost a hundred folk. My brothers and I would continually knock seven bells out of each other.

        The difference between a punch and a murder charge is a medical condition where you are concerned.

        If a rugby player goes for a high challenge and the other player dies is that murder?

              In your scenario you were accepting of being hit. The guy that was killed here did not even know that he was going to be hit. This really was a cowardly, despicable act and not knowing that somebody has a weakness should be no defence whatsoever if you kill somebody in an unprovoked attack.

                    You obviously did not read or understand what I said. I did not have any problem with you fighting people with their consent. What you were doing is totally different from this unprovoked attack.
