Two IR35 defeats cost contractors £130,000

A spate of recent IR35 cases has seen two victories for the Revenue and two for the contractors.

Special Commissioner Charles Hellier, who ruled on both cases which were wins for HMRC found that contractors, Dragonfly Consulting Ltd and MKM Computing Ltd, had become part of the team and integrated into their client companies. Do not mix with permies.

Increasingly its seems that HMRC and the Commissioners are looking beyond the terms of the contract - even back-to-back contracts - and examining the working practises of the arrangement as seen through the eyes of the client. Do not do what the clients ask of you.

In some cases, where the contract has included ' the right of substitution', the client has refuted this would have been the case in practical terms. Some of these cases date back several years.

Some porky pies being told somewhere. I think we worked out that was his total tax liability which implied he hadn't paid any tax over the period he was investigated.

IR35 terrifies me every day. Sometimes I just want to pack it all in.

Can anyone help me with this thought. When I sit down at coffee break and discus my project with other contractors and I implement their ideas, or they send me small bits of code which I use am I actualy using a sub?
When I get the wife to proof read a report or enter values into a spread sheet would that amount to the same thing?
If there is a requirement to payfor a sub then maybe we should all try and farm out some of our work to temp agencies or pay our mates to do a bit for us. I would also suggest doing it without our clients knowledge (where legal) to defacto get around control questions too.
