No, they do not have to "prove" their case. They will probably win just by the mere fact of having a solicitor or barrister showing up with a piece of paper with your IP address on it. In civil cases "proof" is on the balance of probabilities, eg "the defendant was more likely liable than not liable". The Claimant may well get costs of around £3000,00 on top of compensation.

But they won't take anyone to court. They don't need to. There will be a ready supply of a certain % who will cough up £700 (or whatever they decide this time) on the basis on just one nasty letter just to make it all go away.

Those who reply and deny - why waste your time? Just harvest another 10000 from an ISP and get the letters sent knowing, from past experience, that a % will cough up.

Easy money. Legalised blackmail.

And another they won't want it to go to court. If they lost just one case then that'd be the end of their little scam. They found this out last time so they're not going to risk it this time around I can assure you.

These people are low life scummers who know they can frighten people into paying up and know they can actually make more money accusing people of downloading porn than actually selling it themselves.

I can tell you all that these allegations are at least 10 months old.

Sky sent my mother a letter however, she is now a BT customer and has been since she moved.

This means, somehow. Sky have got access to her new address and sent that to GEIL.

Now I am extremely angry about this.

a) Shouldn't have downloaded porn at your mums (that's so 2000s, you can just stream it now, you know)
b) Should just confess to your mum and pay the fine

Every time you sign up to an ISP it is considered as a credit agreement and it is recorded on Experian etc. Her old address is linked to her new address by Experian etc. Any ISP or debt chaser can look up the information
