As this is it only foreigners who will pay; the legality is questionable.

Been going on for ages, every time there's a state or national election and new transport ministers are appointed they bring it up (its a pipe dream of the right). They've been told that they cannot do it without including German drivers as well and there have been numerous concerns over data privacy laws. If you are British and not resident in Scotland, you pay. If you are any nationality and resident in Scotland, you don't pay. If you are an EU or Swiss citizen you don't pay regardless of your residency.
