    I hear in Italy divorce laws are pain in arse time wise - separation for years, only then divorce.

    Question is this: can one party move to say UK and file for divorce here, assuming the other party does not mind, no kids and no money issues in terms of how to split things - can it be done in principle (with the wife living in Italy)?

    It seems to me that some length of residence in the UK will be needed, ie at least 6 months before it falls into jurisdiction of local courts, assuming the wife won't mind.

      It is not for me, even though I have conflict of interest, but I am interested in honest answer.

      Is there some period of compulsory "separation" in the UK which basically means you can't marry until its over? Ie, the divorce is not in effect one second after it was approved by court or what not? This assume both parties agree on all things.

        Divorce

        As far as I understand the UK divorce laws

        A divorce will be granted in the following circumstances

        a) 5 years unconsensual separation
        b) 2 Years concensual separation
        c) If one party admits to adultery (If people want a quickie,uncontested divorce this is what they usually do )

        I am not sure how it works if the marriage was solemnised in Italy, although since Italy is in the EU , there may be some way that the petitioner can apply for a divorce decree here.

        You will need to phone the county court to find out but if the divorce is mutual and uncontested it may be worth getting an apostille(get it legalised) on the marriage cert as I doubt it would be legally valid here without that.

        Hope this helps, but I would advise that you speaka to the county court and if they are unhelpful unf you will need a lawyer.

        If your mate is strapped for cash and assuming he can get divorced using the UK courts I would recommened the selection of online sites which deal with divorce. eg www.divorce-online.co.uk. Even if money is not a problem it is MUCH cheaper and you get the added satisfaction of fulfilling your legal obligations without having to be financially defiled by some scum sucking lawyer

                    Even better, in some US states I think Arizona is one; you only need six weeks residency; one party to file for divorce and it can’t be contested.
