Newbie: OPT in / OPT out IR35 impact?

    A little surprised that OPs accountant reckoned it was IR35 relevant, the Opt In/Out

    And this is one of the biggies in the "Recommended Accountant" list.

    Am also most srprised by the responses below as if the accountant was working for the agency

    " As you are putting the contract through a limited company you need to choose Opt Out. Opting in is for people being employed.

    All the clients I have spoken to have opted out as they are not employed by the agency and opting in implicates on the IR35 status."

      And that is from the accountant? Wow. I have had agents use line about all the other contractors being opted in but even they didn't go as far as to say opting in is for employed people LOL.....

        Don't sign the opt out, it is NOT an IR35 pointer. Read the opt out sticky, this has been discussed at great length.

        Be prepared for the agency to spin you quite a line of bulltulip on this one, they will be desperate for you to sign your legal rights away but stick to your guns and refuse to opt out.
        Free advice and opinions - refunds are available if you are not 100% satisfied.

                oh and don't opt-out. Opting out gives agents an easier live but removes a fair few benefits you really don't want to lose and you gain nothing in return (regardless of what agents and other clueless people say).
