    How to change my contract from PAYE to dayrate

    Wonder if anyone's been in a similar situation or can offer advice on how to proceed.

    I'm on a 6month fixed term role via an agency, the agency pays me PAYE and client pays agency for my time. The initial 6 months is nearly up and, if renewed, I'd like to change this to a day rate rather than PAYE. It was not a problem at the time as I wanted the client/role on my CV.

    I know client pays a day rate to the agency for me so wondering how to approach this conversation with the agency.

    Simple tell the agency you want to be paid a daily rate.

    The agency can push back as the contract with the client could be for a temp rather than a contractor.

    (If you don't know the difference I suggest you do some research on google.)

      Thanks SueEllen yes I had that approach in mind, I just wondered if there were any legal issues around that as I had signed with the agency as an employed consultant...

      I'm relatively new to contracting and was on a day rate on a previous role.

        Spring/Hyphen are the biggest agency pushing this type of contract and I won't use them because of it. Ask your fellow contractors who are on day rates who they work through, I'll bet it's not the same as yours.

          I'd take some professional (ie. not from the agency) advice about any impact on your IR35 situation if you are essentially going from permanent employment paid via PAYE and an alternative payment scheme.
