First Contract - VAT and Joining date

    Hello All

I received my first contract, in a software company on London. The starting rate is not great but good for time being.

    I have following questions:
    - The contract does not mentioned any thing about VAT, does it mean it goes from my amt? Should be able to charge them irrespective of what is mentioned on my contract?

    - The payment terms are monthly. Is it normal?

    - There is no notice period mentioned, in the contract.

The suggested joining date is from tomorrow, but I want to only start on after a 12 more days. How shall I approach for that.

    Please advice.

If you are registered for VAT then you must charge it by raising an invoice for the amount with 20% on top for VAT, if you aren't registered then you don't add the VAT on top, simple.

Monthly payments terms are pretty common.

No notice period in the contract is a good thing from an IR35 perspective. As for a start date, did you not negotiate it with the agent/client beforhand?

I take it you're new to contracting? If so I would carefully read the stickies on the forum boards as there is a lot of very useful information in them

You at least want the client to have a notice period, from an MOO perspective (I think).

And if they have one, it is good business sense to have one yourself even if perhaps of a longer duration than the client side.

I suggest the OP gets a contract review from QDOS/B&C et al.

WTF is that supposed to mean? Are you Indian? It's no wonder projects run in to problems with this level of communication.

I'd get that sorted quickly with the agency (or client if you are direct). If you have misunderstood the rate discussions, and end up 20% out of pocket, then you won't be too happy.

I remember getting my first invoice paid and being ecstatic because I'd just received 17.5% more than I was hoping for I'm pretty sure I wouldn't be happy if it was the other way round!!

Nothing is normal. I've been on 7 day terms up to 60 day terms (as at the moment). Depends on your negotiating skills and what the client / agency want to do.

When did you tell them you were available? If you said that you were available immediately, and now you're saying that you aren't available for another two weeks, then I'd start wondering what else you'd lied or forgotten about at the interview, and ditch you completely. Discuss with the agency / client - negotiation is what you need here now that you are in business for yourself.
