Applying to a position both directly and through an agency

Hi,

I recently applied to a position directly on the company's website. However, one day later a recruitment agency sent my resume to the same company (I was thinking it was for another position but it actually wasn't).

The company started the recruitment process by using my direct application and I was wondering if it could cause any problem regarding the recruitment agency? I had them on the phone and I told them I applied directly before they talked to me about the same position (I have some emails to prove it).

Since I first applied directly to the company, is there still any risk for me to be sued by the agency for bypassing it?

Why do people assume just because they do something that might be construed as not correct that they will get sued? This isn't America..... yet...

Do we assume this is a permanent position and not a contractor one?

Well, I was just thinking it was the worst case scenario! And yes, it is for a permanent position, not a contractor one.

You cannot be sued by the agency, you have no agreement with them. End client may have issues if agency was 'effective cause'.

No. The agency might try it on but just tell them to bugger off.

Just keep going with the direct application with the company

And just tell the recruitment agent that it was a misunderstanding and the company already has your CV. I'm sure they will react and make it sounds like it's your fault..... Oh well, these things happen... all the time. They shouldn't be that surprised.
To me, it sounds like the recruitment agent didn't describe the role very well to you when they approached you. If it made you think it was for a different role.
