I've been working at an NHS trust for 8 months (initially a 6 month contract which I renewed twice). My current renewal ends at the end of January.
A fellow contractor just informed me that last month she received an email from HR saying they were instituting the IR35 checks here
. I knew these might be coming a few months ago, but I thought I could just quit if they ever hassled me (I should be outside IR35, but I'm not interested in handing my company documents over to them or speaking to HMRC's "IR35 helpline").
I didn't receive the email, so I don't know if I am in the firing line or not, but the kicker is that if you do not supply them with the necessary information, they will report you to HMRC! So quitting doesn't help.
I should be OK, but no way in hell I am renewing at the end of this month, and I would walk today but I don't have a notice period. Here is the email that was sent, which my colleague forwarded to me:
"Further to guidance for all public sector bodies in relation to the treatment of consultants and their tax arrangements by Her Majesty’s Treasury (HMT), CLIENTNAME has conducted a review of its contractors and has established that the guidance from HMT and the associated tax reporting implications apply to you.
This is because you have provided services to CLIENTNAME for which you have been paid for those services via purchase order payment as either a sole trader, through a limited company or through your own limited company. As a result, CLIENTNAME must report to HMT on the status of your tax arrangements and therefore clarification on this matter is urgently required from you.
If CLIENTNAME does not receive any formal communication from you in this regard or if you do not provide the necessary assurances by Monday 7th January 2013, your details will be forwarded to Her Majesty’s Revenue and Customs (HMRC) in accordance with the requirements set out by HMT."
