        Maidenhead is only a 20 min drive from where I live!

        Don't worry about leaving you current role; you have to look after yourself and achieve the most you can in the short time we have on this planet. Just be professional in how you let the client down.

        You might want to advertise your current role here to see if any of the benched guys fancies it. This would help both the client and a benched colleague.

        So you're back up to £400/500? Where are you going to be based now?

          I wouldn't wish my current client on anyone on this forum .

          They need a permy and they need to put their money where their mouth is and train someone for the role.

          Advertising for a skillset miles above and then giving someone spreadsheets and 50% of the rate, is not the answer.

          That said I think , sadly, it did serve its purpose in making my CV "active" in the eyes of these numpty agents who see gaps as fails.

          I'll let you know how this goes - I have a MOO clause, but its paired earlier in the document with a "if you cancel early you pay us what we would have got in commission" clause... Contradiction in terms, but this is going to be stressful I think. The agents sitting on 21 days worth of invoice too; its my year end and I need at least 14 days of that to cover my corp tax liabilities..

          Its been a bad year - but its got much better in priniciple

            Glad to see that things are on the up. I've been following your threads and you needed some good luck for a change and hopefully you can work out a compromise with the agent.

              Thank you.

              I should have noticed these clauses on paying the agents commission were a bit dodgy.

              I learnt last week that so far in 5 months 1 guy had a heart / angina attack on the job and another a nervous breakdown, im guessing that's why they added those terms.

                It would be difficult for the agency to prove what they would have received in commission - if you stayed but did no work, then you would invoice £0 and their commission would be £0. So trying to prove that you cost them anything is hard for them to argue.

                If you are opted into the agency regulations (ie. did not opt out, in writing, before being introduced to the client) then they have to pay you if you did the work. Of course, one could question why you need the money now to pay for the corporation tax which is due in ten months time....

                    They've got 3,000 of invoices outstanding so im a bit worriedtey won't pay. I usually do opt out but ill check my contract again.
                    I never thought id have to break a contract on these terms.

                    My accountant advises me that I should ensure that there's enough money in there to cover the liability at the end of my financial year. I've took it as a given, but can't remember working this way in the past.
