Do they have to pay the full contract?

Sorry I am new at this and I was currently told they may cancel my 6 month contract early. I have till the 9th July 2012 on the contract.

I am not going through an agency and working on their contract on a 6 month.

I am not Ltd or sole trader. I am being paid via there payroll dept.

In there manual it says they must give 3 months notice unless I do some gross misconduct which I have not.

    Advice please. Thank you

On the face of it they have to pay you. Get some advice from CAB or a lawyer if they are not going to. What have they said?

    IANAL

Ah I see you're on payroll. What do you mean "in their manual". What matters is the contract. Check the notice period in your contract.

It would be surprising if they had a 3 month notice period I wouldn't expect anything more than a 4 week notice period.

It is unlikely that they would breach your contract, but best to double check.

If you are on their payroll it is a fixed term contract rather than a B2B contract, but the details of the contract must be honored.

Things we will need from you:

Exact details of why the contract has come to and end, if it is misconduct (even though you may not agree with it) they can cancel at any time. Secondly clarification of what is the notice period in your contract and when you are leaving, you say 3 months if they have given you notice to end in July that is 3 months so they have honored the contract.

Long story short, no they probably don't have to pay the remaining contract but we need more information, preferably in some sort of derivative of the English language.

It will depend on what is contained in your fixed term contract - what is in the 'manual' in terms of notice is unlikely to apply unless you are a permanent employee with a minimum amount of time served e.g. 2 years

The Contract basically tells me it is a 6 month Contact, paying £ per annum.

The rest of stuff is in a handbook that is generic to everyone.

Does the contract reference the manual?

Then istm they have to honour the terms in the manual. You need to contact a specialist employment lawyer immediately as I am sure that a letter from m'learned friends will have the desired result.

                  Best of luck,

                  Boo
