    Going for Perm to contract Handcuffs clause

    Hi,

    I have currently accepted an offer of perm. employment with a company. The decision was due to the poor contract market condition and also to get some decent war chest before I go on to contracting.

    The idea is that in few months’ time I will be leaving my new perm. job and will look for contracts.

    The perm. contract has some clauses which stop start a company while I am employed with the company and it also stops me to work for the competitor for the next 12 months immediately after I leave the job.

    Is it going to be an issue (legally) while I look for new contracts for 1st 12 months? I.e. I will be limited to only certain types of contract.

    You can build a warchest up in a couple of months in a perm job???

    Bearing in mind it is in black and white about working for competitors of your employer I will let you work that one out for yourself but...

    12 months is a bit steep. I think it has been mentioned that this is unenforceable as it is against your human rights to work. 6 months is quite enforceable of course.

    Also check your contract carefully, it often mentions customers and suppliers of your employer as well as competitors.

      I already have some monies but I have some expenses comming up in next few months and also looking at the current state of the market I accepted this offer.

      In the contract there is no list of competitors/suppliers/customers.
      I know they are trying to protect their business domain. I am in IT Softwares. The application that I work on can be used anywhere within any business domain. So does it mean they can stop me working on similar applications to company who are in different business domain.

          Thanks very much. I have found a few. In Pertc. this one: http://forums.contractoruk.com/busin...gal-stuff.html

          It looks like many companies have these kind of clause these days but in practice they dont enforce it until you are going to be in direct competition with the business. If I just want to go for Software Dev contracting and use my skills; companies usually dont bother as far as I dont use the IP of the company.
