Agency restriction quistion

    I had decided to carry on based on what everybody said and now I've had the threatening email saying they will spare no expense to stop me working there.

    I just want to keep everybody happy but it aint going to be that way.

    I could walk away completely and find something else

      Is this agent a regular supplier to the client? Does the client know?

        Yes he is and the client does not know. They are expecting me to start soon, have no idea that I might be forced to pull out

          Shame they didn't spare any expense in getting their contracts written out properly in the first place.

          They are likely to pay someone to write nasty letters to you. This someone maybe a solicitor but there is nothing for you to be afraid off. This is because the solicitor will write what they want to frighten you into giving up or paying up. However if it gets before a judge what they have written is extremely unlikely to stand up.

          You do need to acknowledge the letters but your best response is to wait a few days and just tell them in your reply that you will send a longer response in due course.

          That's what the agent wants you to do. They aren't going to get the money anyway.

          Inform everyone which includes client, other contractors, other agent what they are up to. You can do this until they start court action against you.

            I hear what you are saying but its the risk of ending up with nothing. I may have a route back to my current role so I might just say feck-it and pull out.

              I'm not going to be harassed by these guys, I will take the job end client knows about it now and they are extremely annoyed and I think they will instruct Agent A to
              cease and desist.

                Just had a very threatening email saying they will take it all the way and that I have caused them a loss. You couldn't write this stuff as a comedy sketch

                  By the sounds of it they have caused themselves the loss by annoying your client they've lost all future work from them. oops.

                    Put in a subject access request under the Data Protection Act for all info held about you. Won't do you much good but might be fun. You can then report them to the Informaiton Commissioner for potential non-compliance. Or summat like that.

                      OK, I've had another thought. What exactly is the "usual restriction clause" you mention? If it's more than 14 weeks from the start or 8 weeks from the end then it's not valid as you didn't opt out of the agency regulations so tell them to shove it.

                      Remember that they can only take legal action against your LTD company, not you personally and if it came to court then your LTD can cease trading and they will get nothing.
