        I have to go back and forward trying to resolve the issue, Agent B has been no problem but they are in a position to withdraw me as a candidate for the role and present someone else

          My advice would be to tell Agent A to put up or shut up. And tell Agent B that you are ready to start.

            I'd love to but I can't take the risk that they are bloody minded and try and take it to court and end up preventing me from working there, I then end up out
            of a job.

            I just need a legal expert to tell me for sure there is not case even if they tried but that doesn't seem easy.

              Tell Agent A in writing what you have already been told here that your legal advisor* informed you:
              1. That the opt-out clause is invalid due to the way it was conducted.
              2. As you are opted-in the restrain of trade clause is invalid

              And if they wish to go to court then go ahead. (Injunctions cost a minimum of £3,000 plus VAT) Add in that you will counter sue if you lose the opportunity due to their conduct.

              Most importantly stop talking to agent A on the phone. Tell them they need to do everything in writing so you can forward it to your legal advisor.

              *Legal advisor can be anyone. If you need to get a solicitor then go get one.
