Thanks, just had another call with Agent B, they are convinced everything is ok, Agent A says he is digging in and I will probably lose out because Agent B will just find someone else -

My advice would be to tell Agent A to put up or shut up. I just need a legal expert to tell me for sure there is not case even if they tried but that doesn't seem easy.Comment

Tell Agent A in writing what you have already been told here that your legal advisor* informed you:
1. That the opt-out clause is invalid due to the way it was conducted.
2. As you are opted-in the restrain of trade clause is invalid
And if they wish to go to court then go ahead. (Injunctions cost a minimum of £3,000 plus VAT) Add in that you will counter sue if you lose the opportunity due to their conduct.
Most importantly stop talking to agent A on the phone. Tell them they need to do everything in writing so you can forward it to your legal advisor.
