AMS Telecoms contract termination payment question

Hi Everyone,

I am 3 months into a 6 month contract with AMS and a telecoms company.
As most of you know, AMS pay 30 days after the event.

Family have moved to OZ, and I planned to leave after the contract was up, but now reconsidering everything.

My question to you good people is this:
If i terminate my contract, would I still get paid for the work I had done within the 30 days in lieu (all invoiced on time) ?

Any help would be hugely appreciated.

You should get paid as per your contract terms.

It depends on your contract but if you give the notice required in your contract then it's most likely that you will be paid. You have an even stronger case if you didn't opt out of the Agency Regulations.

Not suggesting your Agency would, but some agencies may threaten to not pay you for breach of contract. Even if you don't give notice they are still required to pay you and you could take them to small claims court if they didn't.

Have a chat to them and the client about it and be prepared to do a professional handover to whoever takes over from you.

You could take them to court (and win) if it's proven you haven't breached the terms. If contractor has breached, it would prove difficult, also if their client refuses to pay then contractor will be snookered, generally.

There is only a statutory obligation to pay if the contractor is on a 'opt-in' contract, that's my view at the moment.

Good answers from the previous two posters but IMO both have missed the level of the question by assuming it is more complicated than it is. As I see it the OP just doesn't have a grasp of the very basic fundamentals of payments and is asking if he leaves tomorrow do they with hold his pay. He is not understanding the companies payment terms etc... Sometimes when a question looks as ridiculous as this.. it is!
