    Contract witrh wrong Length and Hours

    Hey guys

    I went for a role for a 2nd line support analyst in the interview I found out its 3rd line. I was offered the job but at the same rate as what I went for (2nd line) tried to up the rate but agency wasnt having it. Anyway due to current situation I accepted.

    NOW

    I get the contract through the post with wrong length of contract, NOT the 3 month that agreed but only for 8 weeks and also NOT the hours agreed. I went in thinking its 37.5 hours the client told me its only 35 hours, on the contract it still says 37.5.

    When I spoke to the Agency he said its only guide lines!

    Anyone ever had similar issues?

    Sounds like the agency is pulling a fast one to me.

    Speak to the client and ask them how long they expect you there for, I bet it's what's in the contract.

      If it's only guidelines ask them to write that in the contract. Don't trust what the agent says.

      Check the contract length with the client as already said.

        Sort it before you go in, presume you are being paid hourly, in which case clearly it matters.

            If this is an hourly rate, actually sounds like this is in your favour, i.e. you can earn more if you want to. HR/contracts management do fiddle around with hours and things, the more the better. The guideline comment is good it would appear to be a maxiumum so the client expects you to do 35 hours, but if you do 37.5 you´ll get paid.

              Hmm, maybe the extra hours qualify for overtime at the overtime rate? That would be even better, so check the contract...

                Thanks for the advise

                Things yesterday went from bad to worse, they didnt want to change anything in the contract and they said to me you can do any hours you like (strange) so I asked my line manager and he said no you do 7 hours and your timesheet should only say 35 hours unless I want you to do over time. Anyway in the contract they didnt mention my LTD company but rather just me as a contractor which I found strange as other contracts had my ltd company instead of me (contractor) i spoke to my accountant and he said this can cause issues with IR35 due to you the contractor contracted to the agency and not you as a Ltd company. So with so much going wrong, the agency spoke to me again and we couldnt come to an agreement so he said you have to give a month notice if you want to leave (just like that, out of the blue) i said i wasnt planing to leave but was hoping to come to a compromise but now that u say it, u want a month notice for an 8 week contract? he said yea, i said no i will give you a week, then he sent me an email saying your contract has been terminated and you have been removed of our Database. what a load of horse crap. I am back on the bench again!
